WHY DO INHERITANCE DISPUTES ARISE?

When you experience the loss of a loved one, the grief can be indescribable. It's likely that your view of the world will change, and you may not recognize yourself for some time. While it's possible to regain your sense of self and come through the grief process a stronger person, it's also possible that tensions may arise between you and the people you love.

When the time comes to process your loved one's estate, you or other family members may be unhappy with the directives in the will or trust. Due to the fragile emotions held by all during this difficult time, disputes can often arise. The following are some of the most common causes of inheritance disputes.

The Will Is Not Updated

You or another family member may have heard the deceased loved one talk about their last wishes shortly before they passed away. If the will was not updated in accordance with these wishes, a dispute may arise.

Perceived Inequity

Some family members may feel that they did not get the inheritance they deserved. A dispute may arise, for example, when one sibling is awarded more than the others.

Belief of Wrongdoing

Family members may believe that their loved one was manipulated into changing their will at the end of their life. If this were the case, they may be able to challenge to will on the ground of undue influence.
